Distance Sales Agreement

1. Parties to the Agreement

1.2. The Buyer:

The Buyer (referred to as the "Customer," "Buyer," "you," or "your") is any natural person or legal entity who places an order for products or services on the Seller's online e-commerce platform located at mensharness.com. The Identity, Contact, Billing, and Shipping information of the Buyer is determined by the details provided during the checkout process and recorded in the system upon order submission.

2. Subject of the Agreement

The subject of this Agreement is to determine the mutual rights, duties, and obligations of the Parties regarding the sale, payment, shipping, and delivery of products ordered electronically by the Buyer on the Seller's website mensharness.com. This Agreement is drafted in accordance with international consumer protection frameworks, the UN Convention on Contracts for the International Sale of Goods (CISG) principles, European Union distance selling directives, and other applicable regional consumer protection laws governing online transactions.

By checking the "I Accept the Distance Sales Agreement" box at the checkout and completing the payment process, the Buyer warrants that they have read, understood, and agreed to all provisions contained within this Contract.

3. Product Details, Pricing & Total Cost

The type, quantity, brand, model, color, sale price (denominated in United States Dollars - USD), shipping fees, and estimated delivery parameters of the ordered products are detailed in the invoice, order summary page, and the confirmation email sent to the Buyer. These digital records form an integral, inseparable part of this Agreement.

The Seller reserves the right to correct any typographical, technical, or clerical pricing errors on mensharness.com prior to the formal dispatch of the goods. If an error is identified after an order has been submitted, the Seller will contact the Buyer to offer a choice between a refund or purchasing the item at the correct price.

4. General Provisions

By entering into this Contract, the Parties agree to the following general conditions:

  • The Buyer warrants that all personal, billing, and shipping details provided during order creation are accurate, complete, and current. The Seller shall not be held liable for delivery delays or failure caused by inaccurate address details provided by the Buyer.
  • The Seller is responsible for delivering the ordered products in sound condition, complete with their specifications, tags, original packaging, and user guidelines (where applicable).
  • As the products include highly personal intimate apparel, harnesses, and body accessories, the Seller operates a strict discreet packaging commitment. All shipments are packaged in plain, unbranded boxes or mailers with a neutral return address. The brand name Mens Harness will not appear on the exterior of the parcel.

5. Payment Provisions & iyzico Security

The Buyer must pay the total transaction value (including shipping fees and any applicable transaction charges) through the online payment gateway provided on the website before the shipment is prepared. All payments are securely processed via iyzico, the Seller's authorized third-party payment partner.

Acceptable payment methods include international credit cards, debit cards, and other regional payment schemes made available through the iyzico checkout portal. All data transmissions are protected via SSL encryption and PCI-DSS compliance. The billing details will reflect a neutral corporate descriptor corresponding to our secure iyzico merchant profile to protect the Buyer's privacy. If the card issuer fails to authorize payment, the Seller reserves the right to cancel the order immediately.

6. Shipping & Delivery Conditions

The ordered products shall be dispatched within the processing times indicated on the product page (typically 2-4 business days for standard items and 5-10 business days for handmade or made-to-order harnesses). The shipment will be delivered to the physical address designated by the Buyer during the checkout process.

International Customs & Tariffs: The Buyer acts as the importer of record and is solely responsible for paying all local customs clearance fees, import duties, tariffs, VAT, or other regional taxes levied by the destination country's authorities. The Seller has no control over these charges. If the Buyer refuses to accept a package due to customs duties, the package may be returned to the Seller or abandoned. In such cases, the Seller will deduct all original shipping fees, return shipping fees, and administrative customs costs from the Buyer's refund.

Order tracking is available to the Buyer via /account/orders once the package has been handed over to the courier partner (e.g., DHL, FedEx, UPS, or national postal systems).

7. Right of Withdrawal (14-Day Cooling-off Period)

Subject to the hygiene exclusions outlined in Section 8, the Buyer has a statutory right to withdraw from this Contract and return any eligible products within **fourteen (14) calendar days** without providing any reason or incurring any penalty. The withdrawal period starts on the day the Buyer, or a designated third party (other than the courier), physically receives the goods.

To exercise the right of withdrawal, the Buyer must notify the Seller by transmitting a clear, written statement of their decision to withdraw via email to info@mensharness.com before the 14-day period expires. A sample withdrawal form is provided in our Cancellation and Right of Withdrawal page.

8. Exclusions from the Right of Withdrawal (Hygiene & Custom Goods)

The Buyer acknowledges and explicitly agrees that, in accordance with global consumer protection regulations, the right of withdrawal and return is completely excluded for the following items:

  • Intimate apparel, lingerie, bodysuits, briefs, harnesses, and body accessories whose original protective packaging, hygiene seals, or security tags have been opened, unsealed, or tampered with after delivery. These items are excluded from return due to health protection and hygiene reasons once unsealed.
  • Any goods that have been custom-made, tailored, altered, or personalized according to the Buyer's specific measurements, options, or requirements.
  • Products that show visible signs of wear, physical damage, washing, perfume/body odors, or missing original labels and packaging.

9. Default, Late Payment & Card Security

In the event that the Buyer's financial institution cancels, recalls, or initiates a chargeback for a completed payment transaction without a legitimate, pre-approved contractual reason, the Buyer shall be deemed in default. The Buyer agrees that the terms of their credit card agreement with their issuing bank regarding interest rates, late fees, and legal liabilities will apply.

The Seller reserves the right to pursue all legal remedies, file reports with fraud prevention agencies, and recover any administrative fees, collection costs, or legal expenses incurred during the resolution of bad-faith payment disputes or chargebacks.

10. Personal Data Protection

The Seller processes and protects the personal data of the Buyer in strict compliance with the General Data Protection Regulation (GDPR) and the detailed guidelines set forth in the Privacy Policy. Buyer details are shared only with essential third-party service providers (such as the payment processor iyzico and global shipping companies) to fulfill the performance of this Contract. By executing this Agreement, the Buyer consents to the processing of their data for these transaction-related purposes.

11. Dispute Resolution, Competent Forum & Severability

This Contract is governed by and construed in accordance with the laws of [Company Legal Name]'s registered jurisdiction, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Any dispute, claim, or controversy arising out of or relating to the execution, performance, or interpretation of this Contract shall first be addressed through amicable negotiation. If an amicable settlement cannot be reached within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of the Seller's registered jurisdiction, unless regional consumer protection laws in the Buyer's country of residence mandate access to a local consumer court or dispute resolution tribunal.

If any clause or provision of this Contract is declared invalid, illegal, or unenforceable by a competent court of law, such invalidity shall not affect the remaining clauses, which shall continue to be fully binding and effective.

12. Entry into Force

This Contract consists of twelve (12) sections and enters into force immediately upon the digital authorization of the Buyer during the checkout process on mensharness.com. By completing the payment through iyzico, the Buyer acknowledges that they have read, fully understood, and accepted all the terms, conditions, and exclusions set forth in this Distance Sales Agreement.
